        4. The personal information we collect

        Depending on how you interact with us, we may collect the following categories of personal information:

            • Enquiry and communication data: the content of messages you send through our contact forms, email, WhatsApp, social media, or live chat.

            • Client and billing data (where you become a client): billing contact details, services requested, and information needed to deliver and invoice for our services.

            We process personal information only for lawful purposes and on a recognised legal basis under POPIA — your consent, the performance of a contract with you, our legitimate interests, or compliance with the law. Our purposes include:

                • Managing our client relationships, projects, quotes and invoicing.

                • Sending you marketing communications where you have opted in (see Section 16).

                • Operating, maintaining, securing and improving the Website.

              We process information in accordance with the eight conditions for lawful processing set out in POPIA: accountability, processing limitation, purpose specification, further processing limitation, information quality, openness, security safeguards, and data subject participation.

              7. CFM as an Operator for our clients

              As a digital marketing agency, we sometimes process personal information on behalf of our clients — for example, when we manage a client’s advertising accounts, run their campaigns, or handle data captured through their channels. In these cases CFM acts as an Operator under POPIA, processing that information only on the documented instructions of the client (the Responsible Party) and under a written operator agreement that requires appropriate confidentiality and security. This policy governs the information for which CFM itself is the Responsible Party.

              8. Cookies and tracking technologies

              Our Website uses cookies and similar technologies to function properly, remember your preferences, analyse traffic, and measure advertising performance. These include:

                    • Meta Pixel: Our Website may include the Meta Pixel, which collects technical and interaction data (such as pages visited and actions taken) to measure the effectiveness of our advertising and to show relevant ads.                     • Custom and lookalike audiences: We may use information such as your email address or website activity to build advertising audiences on Meta’s platforms. We only do this on a lawful basis.

                    • Page and ad interactions: When you interact with our Facebook or Instagram pages, ads, forms (including Lead Ads) or messages, we may receive the information you choose to share.

                    • WhatsApp / Messenger: If you contact us via WhatsApp or Messenger, we process the messages and contact details you provide in order to respond to you.

                    • Facebook Login / app integrations (include only if applicable): If you choose to log in or connect via Facebook, we receive the information you authorise Meta to share (such as your name and email). Our Meta App ID is [App ID].

                  Your control over Meta data:

                     

                      • You can adjust your ad preferences and off-Meta activity settings directly in your Facebook and Instagram account settings.

                      • You can revoke any permissions you previously granted to us in your Meta account’s “Apps and Websites” settings.

                      • You can request that we delete the data we hold about you at any time (see Section 10).

                    Your use of Facebook, Instagram, WhatsApp and Messenger is also governed by Meta’s own Privacy Policy and Terms, which we do not control.

                    10. How to request deletion of your data

                    You may request that we delete the personal information we have collected from or about you at any time, free of charge, and regardless of where you are located. You do not need to provide a reason or obtain our approval.

                    To request deletion, contact our Information Officer at [info@classicfusionmedia.com] with the subject line “Data Deletion Request”. We will action verified requests without undue delay, subject only to information we are legally required to retain (for example, tax and accounting records). Where deletion is not possible for a legal reason, we will tell you why.

                    If your data was collected through a Meta Platform integration, you may also withdraw access or remove the app in your Meta account settings, which will trigger our deletion process for the associated data.

                    11. Sharing and disclosure of personal information

                    We do not sell your personal information. We may share it with:

                       

                        • Operators / service providers who process information on our behalf (for example, hosting, email, CRM, analytics and advertising platforms), under agreements that require them to protect it.

                        • Authorities or regulators, where required by law or to protect our legal rights.

                      12. Cross-border transfers

                      Some of our service providers (such as Meta, Google and email or hosting providers) are located outside South Africa. Where we transfer your personal information across borders, we do so in accordance with section 72 of POPIA — only where the recipient is subject to laws, binding rules or agreements that provide an adequate level of protection comparable to POPIA, where you have consented, or where the transfer is necessary to perform a contract with you.

                      13. Security safeguards

                      In line with section 19 of POPIA, we maintain reasonable technical and organisational measures to protect personal information against loss, unauthorised access, and unlawful processing. These include access controls, secure (HTTPS) transmission, reputable service providers, and limiting access to authorised personnel. While we take security seriously, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

                      If a security compromise affecting your personal information occurs, we will notify you and the Information Regulator as required by POPIA.

                      14. Retention of personal information

                      We keep personal information only for as long as necessary to fulfil the purposes set out in this policy, or as required by law (section 14 of POPIA). When information is no longer needed, we securely delete or de-identify it.

                      Under POPIA, you have the right to:

                          • Request correction or deletion of information that is inaccurate, irrelevant, excessive, out of date, or no longer authorised.

                          • Object to the processing of your personal information, on reasonable grounds, free of charge and through accessible channels.

                          • Withdraw consent at any time, where processing is based on consent.

                          • Not have your information processed for direct marketing by unsolicited electronic communication without your consent.

                          • Lodge a complaint with the Information Regulator.

                        To exercise any of these rights, contact our Information Officer (Section 3). You may submit access or objection requests by email or any reasonable means, and we will not charge you to object to processing.

                        16. Direct marketing

                        We will only send you direct marketing by electronic communication (email, SMS, or automated message) where you have consented (opted in), or where you are an existing customer and we are marketing similar services — and in every case we give you the ability to opt out at no cost. Every marketing message includes an unsubscribe option. You can withdraw your consent at any time by clicking unsubscribe or contacting our Information Officer.

                        The Website is not directed at children, and we do not knowingly collect the personal information of children under 18 without the consent of a competent person.
